Question: We read with interest your Q & A on the father and son forgery problem. Our question on using the negligence factor in forgery cases - is there any case law available on this? Our attorneys would like some solid footing here.

Answer: Your attorney can find case law referenced in either Brady On Bank Checks or The Law of Bank Deposits by Barkley Clark. However, keep in mind both of these publications will have cases under the old Uniform Commercial Code. The Revised UCC is really too recent for any meaningful comparative fault case law to be available.
