Security Officer's Personal Liability
Question: I recently attended your class that dealt with the duties of a security officer. I have a question about the liability that could be placed on a corporate security officer. I know you told us that it would be a good idea to get extra insurance in order to cover ourselves in the event that we were sued. Is there anyway that you could give me some extra information about this? Could you give me an idea of where I could point our legal department in order to research this further?
Answer: The best place for your legal department to go right now is legal case history. Your attorney would have more access than you, however, so you might ask him to check out the cases of Pinsonneault vs. Merchants & Farmers Bank & Trust Company and the one in South Carolina: E. Davis vs. Blue Ridge Savings Bank.
USA Today recently had a short blurb on the latter one: "Elizabeth Davis, whose parents were killed in a Greer bank robbery last year, settled her lawsuit with Blue Ridge Savings Bank. Details of the settlement weren't released. Davis claimed that the bank, located in a mobile home, failed to meet security requirements and failed to warn customers of risks. Blue Ridge employee Sylvia Holtzclaw also was killed in the robbery. No one has been charged in the deaths."
You'll note it says she settled with the bank. It doesn't say the suit against the security officer is done with yet. The wheels of justice turn very slowly. We'll have to wait and watch.
