A quick review of enforcement cases brought by the US Department of Justice Civil Rights Division makes something very clear. DOJ is very active in enforcing the disability requirements of the Fair Housing Act and ADA. They have gone after landlords, architects and even local governments for failing to provide for the needs of consumers with disabilities. What this means for commercial lenders is that when making loans secured by public facilities (hotels, restaurants, and stores) or multi- family housing, the lender should take steps to ensure that the borrower is in compliance with all aspects of the Fair Housing Act and ADA. Make sure it is on the checklist.
