WHAT?
During the past few years rules regarding the gathering, evaluating and sharing of loan application information have increased in complexity. The Equal Credit Opportunity Act (ECOA) has long placed restrictions on what information can be collected and evaluated at application. The Fair Credit Reporting Act (FCRA) governs the use of credit reports. A few years ago the new privacy rules placed restrictions on the sharing of information with non-affiliated third parties. FCRA governs sharing information with affiliated third parties. The Customer Identification Program (CIP) rules have modified the application process. Most recently the FACT Act has added to the compliance burden. This two-hour seminar ties together all of the rules that govern the collection, evaluation and sharing of information in the application process.

Upon completion of this program, participants understand:
How to avoid the liability that can result from:
The failure to collect required information;
Improper use of credit bureau reports;
Collecting prohibited information; or
Improper sharing of application information;
The steps necessary to assure proper collection of data;
When and what data can be shared with third parties; and
The common violations that occur during the application process. Participants receive a detailed manual that serves as a handbook long after the program is completed. PROGRAM CONTENT
This two-hour seminar focuses on:
What information must be collected at application
ECOA and Fair Housing monitoring information;
HMDA data; and
CIP information;
What information may not be collected at application (ECOA);
When a credit bureau report may be obtained;
Sharing application information with:
Affiliates (FCRA); and
Non-affiliates (Privacy). WHO?

About the speaker:
Jack Holzknecht
Jack Holzknecht is a principal with Pegasus Educational Services, LLC, a training firm headquartered in Louisville, Kentucky. He is an experienced consultant who has provided training to thousands of bankers and examiners for 22 years. He has the ability to identify the key compliance issues from each regulation. Jack's career began in 1976 as a federal bank examiner. He later headed the form and software and education divisions of a regional consulting company. In that capacity he developed loan and deposit form systems and software. He also developed and presented training programs that were delivered to bankers in 43 states. Jack has been an instructor at compliance schools presented by the Georgia, Iowa, Kentucky, Pennsylvania, Nebraska, New York and Texas bankers associations. He developed and delivered compliance training for the FDIC and OTS for ten years. He is a Certified Regulatory Compliance Manager and a member of the National Speakers Association. He is also a "BOL Guru" and frequently answers compliance questions sent to "Bankers' Threads."
