![]() Monday, March 07, 2005 ( 7:51 AM ) Andy DNC List Shows Its Teeth In a March 1, 2005 news release the FCC has proposed a $770,000 fine against Dynasty Mortgage, L.L.C. of Phoenix, Arizona as they made calls to numbers listed on the National Do Not Call list. The FCC wants the maximum fine for each of the 70 violations, $11,000 each. Dynasty claimed they list of numbers they bought was to have been scrubbed already. However, they continued to make telemarketing calls after receiving an FCC citation warning it of potential penalties for violating the DNC rules. Dynasty told consumers that it was exempt from the DNC rules. There may have been misconceptions because they didn't call out of state numbers. However, the "Notice of Apparent Liability for Forfeiture" from the FCC states, "Dynasty’s do-not-call procedures and training efforts appear to be wholly inadequate to promote compliance with our rules governing the National Do-Not-Call Registry. Dynasty’s violations have continued despite being informed by the Commission’s staff that it was relying upon a non-existent exemption to justify its calls." Dynasty needs to train employees better, maintain written guidelines, have an internal DNC list and regularly update the National DNC list and scrub the numbers they have against it. # |
