I have been away from Visa Disputes for a long time. About 10 years or so.
If a Visa Rule is directly opposite of Reg E, which do we follow. Do we follow the Regulation that which ever is better for the customer is the one that is used?

And also, if it is non-pinned transaction and obvious Fraud our 3rd party provider returned it at no chargeback rights as it was not out or Europe, from an April 20, 2013 Ruling?

This is a correct statement. For example, VISA requires provisional credit in 5 business days for unauthorized transactions, Reg E 10. In order to comply with both you must adhere to VISA's 5 day time frame.

The April 20th rules change can certainly hamper a Reg E investigation. Remember, that your ability or inability to recover the funds for the bank via the chargeback process does not impact your liability under Reg E 1005.6. (or VISA Zero Liability). If you have clearly determined that a transaction is unauthorized and find in the cardholder's favor, your have to reimburse them and accept the loss.

If the transaction is local and you suspect that your cardholder is lying or perhaps a family member helped themself to the card, you can opt to utilize a retreival request to obtain a copy of the sales receipt even though there are no chargeback rights and/or contact the merchant directly to see the can review video footage for you.
