My mortgage dept uses FICS software for loan docs. Fics provided a template with some user defined fields for us to complete for both the credit score disclosure and notice to home loan applicant We called Fics this morning to make sure we have all the fields completed and they said we are the only financial instiuton to be using these disclosures. Am I crazy?

No, you're not crazy! I think that everyone is scrambling to try and comply with this section of the FACT Act and are not quite sure how to do it. I have spoken with many different banks that have not yet addressed this!

yes-we use loan producer.

As is often also the fact, vendors tend to release their forms at the last hour! This is frustrating and many people may have created their own form, just because they wanted to be prepared before Dec 1st.

Our vendor's form is designed to be signed by the borrower. Since there is no requirement (yet) to have the form signed or retained, we developed our own form with no signature lines. Our written policy and practice, as well as our form should be enough to demonstrate compliance. When a credit report is obtained, the form is completed by our underwriting department, the staff of which never sees the customer face to face. It's a tri-fold document that goes into a window envelope. They simply drop it in the mail the same day the report is obtained and compliance is complete.
