When disclosing the amount of funds we had on hand when summons of garmishmnet was received do we disclose the amount with our fee withheld or the amount before our fee? In this case the amount of funds at receipt of summons is less than the amount of the the plalntiff's request -- so can we withhold our fee if there is not an overage in the account?

Any reliable answer would be based on state law; e.g. in some states subtracting your fee before you satisfy the garnishment is contempt of court.

You might try re-posting your question in your state's forum.
