A customer completed an ATM fraud claim for $800 worth of withdrawals. An investigation of the Security tapes revealed a very nice picture of the customer's boyfriend using the card. The customer filed charges against the boyfriend and the Bank refunded $800. The customer promptly dropped the charges against the boyfriend. Can the Bank pursue charges against the boyfriend? Thanks so much...I hate Reg. E.

Absolutely. If the customer brings the claim to you, it is your charge to pursue - not your customers.

I agree. You step into the customers shoes when you assumed the loss. I'd advise her of this and that you will prosecute to the maximum, all parties involved.

Do you suspect now that it was a set up or that she gave him the PIN? If so, I'd work in, all parties involved since you took the loss.

I'll echo the other comments here. Your bank is now the victim, charge away!

On a side note, I also recommend revoking your customer's ATM privileges lest this happen again.
