If you have a loan to a corporation that your insider does NOT control, but personally guarantees and you participate the loan, does the personal guarantee go with the loan? Or, I guess, the real question is do I include the loan in the insider's totals?

If they have guaranteed the loan, then the portion of the loan that you retain on your books would be counted within the insider's loan totals.

Thanks!

So, a 100% loan participation includes all the guarantees that go with it, right? I guess I am just thinking there would need to be a contract clause including the guarantees or something, but maybe I was over-thinking this!

Thanks, again!
