Would someone remind me of the responsibility a bank has when a federal government agency request financial information on a customer. Thanks.

If the agency is subject to the RFPA, it must certify to you that it has complied with the requirements of the Act.

Here is what the customer must do:

Customer Authorizations

Here is what a financial institution must do:

Duty of Financial Institution

Confidentiality of customer records. (Take a look at 3403.(b). This is where the law states the information cannot be released without the government certifying in writing that it has complied with the Act.

1. Go to BOL home page.
2. Click on Alphabet Soup (found under "Main Content" on the left side of the page).
3. Click on Right to Financial Privacy Act (RFPA)
4. Click on Sec. 3411 Duty of Financial Institutions

Let me know if you still cannot find it and I'll post the direct link, but here's Sec. 3411:

Right to Financial Privacy Act
Sec. 3411. Duty of financial institutions

Upon receipt of a request for financial records made by a Government authority under section 3405 or 3407 of this title, the financial institution shall, unless otherwise provided by law, proceed to assemble the records requested and must be prepared to deliver the records to the Government authority upon receipt of the certificate required under section 3403(b) of this title.
