I am looking for some guidance surrounding the Recordation Tax charged on CoOps in DC. There is a transfer tax and a recordation tax on all other purchases in DC, however I have been informed there is only a Recordation Tax charged on Co-ops in DC (2.2% of consideration, and 2.9% of consideration if $400,000 or over).



I am seeking guidance on what line item this should appear on per RESPA. I have a settlement agent telling me it should go on 1203 as the state uses that term interchangeably and it is a tax and not a fee. I am just not sure that is right because there is no “deed” that is being transferred. Also, all of the documentation I have related to REPSA and our GFE fee chart has it on line 1201 which is a different tolerance.



I just want to be sure on the line items for the GFE and HUD as we will be starting to close Co-Ops in DC now as well.
