Among other documents that we give CD customers at account opening, they also obtain 1) Signature Card (that includes the Terms & Conditions and 2)the Truth In Savings. In a recent situation we found that although all Terms were properly disclosed in the Truth in Savings, the line item for the renewal term on the Signature Card was left blank. Customer claims there is no contract because of blank field on signature card although TISA clearly states the renewal term. Which document would take precedence?

Rather than paying legal counsel to give you an opinion after reviewing the documents in total, I would just agree whole heartedly with the customer.

No contract = no CD. Cut them a cashier's check for their balance and the interest they may have been entitled too under the non-existent contract and show them the door.

Who needs customer like this????

Am being devil's advocate here, but if the customer insists there is no contract, wouldn't that mean you do not owe them interest?
