We charged a customer $16.00 on the HUD-1 for a 'DMV Fee' that was not on the GFE. When I inquired about this I was told it was recording fee for an act of immobilization for a mobile home that secured the loan. Two questions:

1. We put this on Line 1302 of the HUD under 'Other Settlement Charges'. Since it was paid out to the DMV should it be with government recording and transfer fees and therefore subject to 10% tolerance (not that it would put us out of tolerance, but I'm just asking for my own information).

2. My processor is telling me that it's okay to call it a 'change' in settlement charge if it's a fee that goes from not disclosed to an amount. But is that really considered a change? In other words, if it is correct for it to be on Line 1302 can we collect the fee if it was not disclosed on the GFE?

Sorry to be so specific about such a small amount, but this is learning time for me.
