I have a loan where the husband is the only signer on the note. The wife signed the mortgage because of the marital rights & primary marital residence. Does the wife need to sign the Final Truth in Lending as well or the Adjustable Rate rider on the Mortgage? Thanks!

The truth-in-lending document does not require a signature. My question is, did the wife get a Right of Rescission. In Kentucky, even if she is not on the deed, she will have the right to rescind due to the dower rights. In Indiana, this is not the case.

I agree the TIL does not need signatures, however I would opine the Rider does. In our jurisdiction we cannot record the Rider without all "owner" signatures.
