We have not done background checks in the past but our new customer information security procedures include this. We have just gotten set up with the local police to do local checks and they require the birth date. My HR person tells me that we do not ask for the birth date because of age discrimination. Of course with CIP the "Equal Opportunity" rules may change too but in the mean time how are others getting around this?

We had applicants complete a form from the local police department and sent the form directly to the dept.

In addition to sending the form directly to the agency, such as the police department, you can ask the applicant to complete a form that clearly states the information is purely for employment verification and the data will not be used as a basis of employment decisions.

This form should be filed separately from all other application materials.
