In Ohio if a rental property is titled in the name of an LLC, must the notarization of the mortgage be for both the LLC and the individual(s) authorized to transact business under the resolution? The Ohio Revised Code (sec. 5301.01) says the mortgage must be signed by the mortgagor (in this case, the LLC) and the signing acknowledged by the mortgagor before a judge or clerk of court of record in the state, or county auditor, county engineer, notary public, or mayor, who shall certify the acknowledgement. Is it sufficient to acknowledge just the LLC and not the individuals authorized to sign on behalf of the LLC?
