Can anyone advise as to the maximum allowable rate of interest in PA for a consumer-purpose, open-end overdraft protection line of credit? (The line is activated upon overdrawing the dda account.) I have looked to national bank preemption and most favored lender status. It seems that we cannot use them. So, I am looking for the correct PA statute for guidance. Thanks

Look up the Simplification and Availability of Bank Credit Act. It establishes a raate cap on both fixed and variable rate loans. The rate cannot exceed the higher of (i) 18% (or such other rate ceiling that the National Credit Union Administration may permit in the future) or (ii) the yield on 5 year Treasury Notes plus 10%. It's been awhile since I read any of this, so this statement may have changed.
