Our ACH agreements are really dated and are need of updating, where might I find a really good example of one or a place that tells me what exactly the agreement needs to disclose?

I don't think the NACHA rule book has a sample agreement. You might want to check out NACHA's webiste - they might have sample agreements in some of their publications.

If not there, then I would probably suggest getting counsel invovled as the agreement needs to cover NACHA rules, OFAC rules, UCC rules, and a whole bunch of other stuff.

A good audit program might cover some of the things that should be in the agreement too.

The NACHA Rules books has a sample ACH Origination Agreement on pages OG 13-19. We started with that and then had legal counsel review. Hope that helps.

I think you'll find that your RPA's also have sample Originator agreements. Your core or ACH processor might also have some.

We received our ACH agreements from UMACHA (MN ACH Assoc). They have them on their website free of charge. Check with your state ACH association. They should be able to help you.
