Recently the OCC issued bulletin # 2007-2 and referenced the UCC, section 3-418 (a), and (b).

I need to get a copy of those sections. Can I use BOL's launch pad to obtain? If so, I assume I would access Article 3. But what if it is different for the state of New York? Where can I get the UCC for NYS? Am having difficulty finding via web.

Thanks...been there and done that. Was able to find the UCC table of contents and some articles, but not the one I need.

I appreciate the assistance. That's NYS for you!

If you click on UCC in the first section, it takes you to the New York UCC. Unfortunately, the trouble that you are having is that New York has not adopted the 1990 revisions to the Uniform Commercial Code for Negotiable Instruments - so you are looking for something that doesn't exist in your jurisdiction.

Thanks. So does that mean that we just go by the "generic" UCC in this case? If so, I'm thinking I can refer to the UCC on BOLs Launch pad. Is that correct?

In New York, we have to follow the New York UCC. We don't get to follow the nationally adopted UCC. Some of the sections are identical but numbered differently. If you don't find what you are looking for under 3-418(a) and (b), you may find it in another section of the NY UCC.

Patrick,

Do you know where I can find the NYS UCC on line? When I visit the link provided above, there's only a table of contents and some of the articles.

This is where I go for all NYS Laws: http://public.leginfo.state.ny.us/menugetf.cgi?COMMONQUERY=LAWS

The UCC is towards the bottom of the list. If you click on UCC you go here: http://public.leginfo.state.ny.us/menugetf.cgi?COMMONQUERY=LAWS

This brings you to the table of contents. Clicking on any of the links will bring you to the text of that section.

Most of what is in the "national" UCC is also in the NY UCC, but under a different numbered section.

Dutch. I also go to Cornell Univ. site that has all the UCCs. Lots of scrolling ahead. http://www.law.cornell.edu/uniform/nyuss.html last time I used it.
