I have a question on NOW accounts and eligibility for an IOTA account for an attorney whose articles show as an LLP.

I understand that LLPs are NOT eligible to open NOW accounts but I also do know that attorneys' trust accounts are. What do I do in this case where the attorney is an LLP and the NOW account that he opened is an IOTA account?

Desperately waiting for an answer...

Do not take my word as I could be very wrong here, but are the IOTA's not for the benefit of the attorney, but of their client or such? Thus the owner of the account really is not the attorney trust, and a NOW is ok then??

IOTA or IOLTA accounts are client funds accounts by definition. They are held in a fiduciary capacity. They can be held in NOW accounts, regardless of the legal form used by the attorney or law firm (LLC, LLP, PC, Partnership, sole prop., etc.).

Regulation D, ยง 204.130(b)(2)
