This act clearly states that the term: commercial electronic mail msg does not include transactional or relatinship msg. If sending email advertisment to existing customers onl, do I need the following?
Have affirmative consent prior t sending email
Allow an opt-out optioin to customer
Contain our valid physical address

Be sure to look at state law for additional requirements. You can't have an e-mail header that is misleading. The message must identify itself as an advertisement or solicitation, must give opt out and contain valid physical postal address. The e-mail must contain a return address.

You need to go back to the CAN-SPAM Act and read the definition of "transactional or relationship message" in Sec. 3(17).

Advertisements don't fall within that definition.
