May a lender charge a tax service fee for loans it keeps/services (non-escrowed) when it is not using a third party service?

It would have to earned to not violate RESPA. If you keep the fee if would also bea prepaid finance charge under Reg Z. Also, you should check State law to see if it is an allowable charge.
