EHL & FDIC Logo Required on Direct Mail Postcard?
by Randy Carey & Richard Insley, BOL Gurus Guru Bios
Question: We are planning a two-sided direct mail postcard. The copy on one side simply states “Living the American Dream.” The flip side lists several of our mortgage products (first time homebuyer, fixed and adjustable rate mortgages, and land and construction loans) as part of the copy. Does it matter which side we place the Equal Housing Lender and Member FDIC logos?
Answer by Randy Carey: As it is all one advertisement, placing the logos on either side should not raise any compliance issues.
Answer by Richard Insley: It's worth noting that the FDIC advertising statement or logo would not be necessary if you are limiting the promotion to credit products. If your ad does mention deposit products, the FDIC logo is not the only way to meet this requirement. Simple statements like "Member FDIC" will also suffice.
