Identifying Branch Bank Name When Different From Bank Charter Name In Advertising
Answer by Andy Zavoina, BOL Guru BIO AND CONTACT INFO
Question: When a branch bank (which has a unique name different from the bank charter name) does a radio ad, do they have to name the official bank name in the ad? What about bank letterhead -- does it have to say "...branch of ...."?
Answer: You should review http://www.occ.treas.gov/ftp/bulletin/98-22a.pdf which discusses an Interagency Statement which urges banks and thrifts that intend to use a different name for a branch or other outlet to take reasonable steps to ensure that customers will not incorrectly assume that the branch or outlet is a separate institution from the bank or thrift, or that deposits in the different facilities are separately insured.
