Returning Remotely Created Checks
John Burnett, BOL Guru Guru Bios
Question: Do you have model language for returning an unauthorized remotely created check? (If not, do you have any suggestions?)
Answer: If you receive checks through the Federal Reserve System, look in their updated Check Adjustments Quick Reference Guide. It will provide you with information on using the Fed to return these items. Otherwise, use a standard "without entry" claim letter addressed to the depository bank, indicating as your reason for the claim, "Customer Claims Unauthorized Remotely Created Check." Include the check and the customer's affidavit that that check was not authorized, and ask for a refund.
