Business LLC & DBA - Two Separate Entities?

Question: We have a Business LLC whose EIN number is to be used on a new business account. However, they are DBA another Business Name, Inc. Don't we need a Certificate of Assumed Name, as they are two separate entities?
Answer: There are probably not two separate entities involved. It's likely that this is a garden-variety "doing business as" situation. John Doe DBA Doe's Dart Emporium; Business LLC DBA Corner Apothecary; Doctors Associates, Inc., DBA Subway Sandwich Restaurants. You may need to obtain evidence of an assumed name filing, depending on your state's laws on such things. That provides documentation that the business has the right to use the assumed name in trade and helps prevent someone from taking over a business's name with a DBA to defraud that business or its customers.
