Power of Attorney on a Joint Account
by John Burnett, BOL Guru Guru Bio
Question: If there is a POA for one individual on a joint account, do you need authorization to accept the POA from the other owner or signer of the account?
Answer: Generally speaking, authorization of the other owner is not required. That might not be the case if state law or a contract provision give the other owner a right of refusal. As a practical matter, however, one owner has the right to close the account if he or she does not wish to deal with the other owner's attorney-in-fact.
