Cashing Deceased Spouse's Checks

Question: A customer's wife just passed away. He gets several checks payable to her from the sale of her books. Can he write her name on the back of the check, then write deceased and write his name under hers and deposit it into the joint account they have? Can he cash them if they are endorsed that way?
Answer: No. The joint account isn't a joint account any longer, even if the wife's name remains. It belongs to one party and you're asking if checks payable to another party can be deposited. No, he's not entitled to cash the checks, either. The only correct way to handle the checks is for them to be given to the personal representative of the late author's estate. They can then be run through an estate account and payments made to creditors, heirs, etc.
