One Owner Garnished - Garnish Joint Account?
by John Burnett, BOL Guru
Guru Bio
Question: There appears to be confusion within the bank on the garnishment of joint accounts when a garnishment is received in only one owner's name. This particular account is owned jointly by husband and wife, yet the garnishment was received on the husband only. Can the account be garnished?
Answer: Subject to any limitations on garnishments in your state's laws (some portions of the account's balance might be protected), joint accounts are reached by a garnishment or attachment in the name of one of their owners.
