Sticky Joint Checking Account Situation
Answer by Randy Carey, BOL Guru Guru Bio
Question: What should I do in this sticky situation? A soon-to-be ex-husband requested his name to be taken off of a joint checking account. The account was closed by the wife just a few days later. The husband has now requested copies of check images from this account. Is he technically an owner on this account to be able to request and receive check images? Some say he may have information up till the date his name was taken off. Others say he is not an owner on the account and has no right to any information. After all he took his name off of the account. Being the person who has to pull the check copies I wanted to know what the legal thing to do would be.
Answer: Call your attorney. This is the reason that most banks do not allow people to be removed from a personal account without the entire account being closed.
