Recording Customer Conversations

QUESTION: Is it ok to record phone conversations from a customer who is giving wire instructions--do we have to tell customer that the conversation is being recorded? If we do not inform the customer, would the recorded conversation be admissible in court?
ANSWER: These are state controlled issues. In many cases only one person has to be aware a conversation is being recorded. You may find information inside your telephone directory on this. Counsel would have to determine when it would and would not be admissible.
