Are check images considered a legal documents?

Question: Are check images considered legal documents?

Answer: In most cases this will still be subject to a state law determination. Many states have passed laws giving imaged documents legal parity with paper documents. There is also some IRS guidance on images of checks, but I don't recall specifically where that is. There is a bill currently pending in the US Congress on Check 21 that will give imaged checks full legal status.
