Question: Do you have a recommendation for the type of language that should be used by a bank on their contracts with janitoral service contracts regarding privacy issues?
Answer:
Janitors pose your most significant threat to identity compromise, thefts involving cash, negotiable documents and property -- and information regarding your facilities' layout and security systems. Many threads have dealt with these issues in detail.
As for your contracts with janitorial firms, let your legal counsel work out the language that specifies:
- Each person who works within your facilities must pass a background investigation before being hired;
- The background investigation components must be to your specifications, including fingerprinting;
- You have the right to have a janitor replaced at any time; and
- Each janitor must sign a confidentiality agreement.
Every institution's needs, policies and procedures will vary -- and this is a source of exposure that you shouldn't ignore.
