Effective date for FDIC amendment to securitization safe harbor rule

The Federal Deposit Insurance Corporation has published a final rule [80 FR 73087] revising certain provisions of its securitization safe harbor rule (12 CFR 360.6), which relates to the treatment of financial assets transferred in connection with a securitization or participation, in order to clarify the requirements of the securitization safe harbor as to the retention of an economic interest in the credit risk of securitized financial assets in connection with the effectiveness of the credit risk retention regulations adopted under Section 15G of the Securities Exchange Act. The rule becomes effective on January 25, 2016.
