Can a partnership account receive cash back on a deposit?
Concerning Reg CC: U.S. Postal Money Orders must be given next business day availability if they are deposited over the counter and into the account of the payee. What are the availability requirements of Japan International Postal Money Orders which are drawn on the same "account/ABA" as U.S. Postal Money Orders? I have searched the Regulation and cannot find anything specific to International Postal Money Orders.
What records must a bank keep regarding cashier's checks that are purchased? Do they have to have a log with the number of the check, when and who purchased it, and to whom it was payable? Where must they keep them and how long must they keep carbon copies?
The independent auditor who completed our BSA compliance review suggested that our bank should find a way to include customer ATM withdrawals when aggregating cash-out transactions for CTR purposes. Most of our customer ATM activity is at other banks' machines, because we only have two ATMs ourselves. Should be include withdrawals made at those other banks' machines, even though we didn't pay out the cash ourselves?
I just ordered Equal Housing Lender posters in October 2007 and another person in the bank ordered them since then. I got mine from the Comptroller of the Currency and the others came from the FDIC. They are exactly the same except for the address for processing under the Federal Fair Housing Act. The posters I received have an address for the Comptroller of the Currency and the other posters ordered have an address for the FDIC. Which is correct or does it matter?
Are we allowed to have picture IDs of customers in the loan files?
I have recently moved into the compliance area at our bank. The previous compliance officer revoked CTR reporting exemptions for sole proprietorships. Is there anything in the regulations that prohibits us from granting an exemption from CTR reporting requirements to a sole proprietor?
At one time we were not to copy drivers license and put them into the credit file. I understand a recent interagency agreement has changed that procedure. Do you have any knowledge of the change?
Several years ago, I was informed by the BSA Compliance group of the IRS that when a bank opens a safe deposit box and discovers cash exceeding $10,000 inside a CTR should be prepared. I have changed jobs and do not have a copy of this consultation, can you advise?
