Bank is working on a commercial line of credit loan (secured by RE). A RE broker is involved and has requested a specific fee amount he wants to collect from this deal. The broker did provide underwriting services for this borrower. Bank generally charges 1/2 to 1% origination fee, but in order to give this broker the fee amount he is requesting and keep a portion of the fee for the Bank's work on this deal, the bank is considering charging a 2-3% origination fee. Are there any limitations on fees for commercial loans? Another factor that may play into this is the fact that the borrower is a single woman. What type of issues do we need to be concerned about if we charge a higher loan origination fee on this deal?

There are no federal limitations. May want to check your state laws.

I smell potential Fair Lending issues here. If you proceed, be sure to document why the higher fee (and substantiate it had nothing to do with sex or marital status).
