For you California residents -- can you help explain?

We were in California and in a raffle won three bottles of wine. There was no room in our checked-baggage (and no time to drink the wine) so we thought we'd ship the bottles to home in Dallas. Unfortunately, we were told "no individuals are allowed to ship wine".

Does anyone know why these rules exist?

Texas - Recent court decisions striking down Texas laws preventing direct shipment have made Texas an open state. Texas law applying to in-state wineries now applies to out of state wineries as well. Texas law allows in-state wineries to ship up to 25,000 gallons of wine directly to consumers, with no per-customer restrictions. That means out of state wineries are now afforded the same privilege, HOWEVER, it is important to note that much of Texas is “dry”. No winery, in-state or out-state can ship to a dry county in Texas. Until the Texas ABC provides detailed shipping information by precinct to ensure adherence to Texas law, we caution our members who are looking to ship to Texas.

I've never lived in a dry county and would probably shrivel away to nothing if not for my lover, Vodka. But AZ used to restrict wine from being shipped in some time ago. It sounds silly but that what they wanted. Enough people pushed to change the law and it was changed.

Oh yes - not to mention Blue Laws. I remember walking into a store in Austin Texas, and the fabric area was "cordoned off" because it was illegal to sell fabric and thread on Sunday.

If you drive through Kentucky, you can always tell when you're leaving a "wet" county and entering a "dry" one by the collection of liquor stores right at the border.

we upgraded the blues laws in the 80's!!!!

but there are still many dry counties, although I am not certain that is the reason no shipping is allowed. It may have more to do with the local vineyards lobbying to keep competition out. Almost all of the 40 or so dry counties are out in West Texas, many very sparsely populated (less than 10,000).

And precincts decide whether to be dry, moist or wet; it's not by county.

Exactly! Right at my county line we have two liquor stores on each side of the road. One is called First Chance/Last Chance Liquors! laugh

which is why DQ did not live in Texas...now considering this move since they will be able to ship her monthly allotment

Pale - folks used to live in north Dallas and would go to a pizza place that was 1/2 in Richardson, 1/2 in dallas. You could order and drink beer in the dallas half, not the Richardson half. Talk about silly...

I've lived in dry counties most of my life. There's still a couple in eastern NM as well. Out here in West Texas - the church lobby and the liquor store owner lobby work together. The Churches keep the liquor out of stores in town, and the liquor store owners keep everyone coming to just outside the city limits to buy their booze! Strange bedfellows...

About shipping wine, though - must be some recent changes. A few years go, tried to ship wine from an out of state winery to an in-state customer, and couldn't get it done. Just a few months ago, though - shipped several bottles.

Lois - I think your winery in CA was just not up to date on their laws.

Not true around these parts

Our towns definition of moist is that only a business that serves food and seats up to 100 people may possess a liquor license. And so much percentage of their sales must come from food profit. crazy I know

Stores do not sell liquor of any kind.

Almost always, I go to a different state for alcohol (this is the county that has both). Three out of the four surrounding counties only sell beer, and only one sells liquor by the drink. I think one of the other counties just voted to sell liquor by the drink, too, though, which I guess would moisten them a bit more.. you can buy beer in these counties.

Pennsylvania is it's own hybrid. Since we have a State Liquour monopoly, bringing alcohol into the state is against the law. However, due to the high number of wineries that want to ship out, PA is finally allowing some wines to be shipped in.

We are close enough to the border to head south for our alcohol needs, and then we don't pay the ridiculous taxes that PA charges.

In New York, there are only four hours out of each day of the week in which alcohol may not be served: 4:00 a.m. to 8:00 a.m.
