This idea was given to me by our marketing department that was given to him by another department. Would we be able to design ads to market to specific professions? For example design an ad that would show the services and the benefits our bank can provide the dental community? I have not seen this before. Thanks.

Certainly. I've seen this kind of targeted advertising in metro business journals or in state or national trade publications. Using more general media I think you'd be wasting ad dollars.

The "effects test" is always a concern when you market to targeted audiences. Even though the practice may not discriminate on a prohibited basis, if it is disproportionally unfavorable to a protected class, you may have backed into illegal discrimination.

I would like to underscore the question about the wisdom of running a public ad to address a targeted audience. That is a big waste of money in my experience. There are much more effective and less costly ways to do this.

We created industry-specific brochures as leave-behinds for our calling officers. The brochures identified products and services those specific types of businesses would be interested in. We targeted the medical profession, the manufacturing industry, non-profit organizations, the agriculture industry, educational institutions & government entities, retail business, professional firms (lawyers, accountants), and insurance agencies. Initially, the officers made call blitzes to each targeted industry.

So for example, we can offer employees of Joe's Pizza Place $10.00 to open a checking account but not offer it to employees of Jane's Donut Shop??

There are no "fair deposit" laws. If you were talking about loan discounts you would have to analyze for disparate impact issues.
