On a safe deposit account that is past due over 2 months, repeated attempts have been had to have the customer pay the amount due is okay to use the right of off set to deduct the amount owed from a checking or savings account that they have at our bank? There is disclosure on our lease agreement. Where should I look to ensure that this is legally okay?

This is an answer that you should probably find from your financial institutions legal 'team' - right of offset may be available to you if it is properly outlined in your new account disclosures and your safe deposit contract - how do they read?
