I an reviewing our Reg CC hold policy and I am looking at the reg and all I can find is that it does not specify the hold period for new accounts. Where can I find this?

I am sorry but I don't see it. I see that everyone uses 11 days for local and non local checks, but I don't know where that came from.

For new account holds on next day items, the amount over $5,000 can be held for 9 days. A bank can set its own policy for how long it will hold local and non-local checks deposited into new accounts.

Following is the model language for the "new account hold" disclosure:

Special Rules for New Accounts

If you are a new customer, the following special rules will apply during the first 30 days your account is open.

Funds from electronic direct deposits to your account will be available on the day we receive the deposit. Funds from deposits of cash, wire transfers, and the first $5,000 of a day's total deposits of cashier's, certified, teller's, traveler's, and federal, state and local government checks will be available on the first business day after the day of your deposit if the deposit meets certain conditions. For example, the checks must be payable to you (and you may have to use a special deposit slip). The excess over $5,000 will be available on the ninth business day after the day of your deposit. If your deposit of these checks (other than a U.S. Treasury check) is not made in person to one of our employees, the first $5,000 will not be available until the second business day after the day of your deposit.

Funds from all other check deposits will be available on the (number) business day after the day of your deposit.


Generally, your bank can insert almost any number it wishes in the last sentence. This is an internal decision most banks made about 20 years ago; it's unlikely you will find someone who remembers why that number was picked.
