If a loan is made to an entity in USA for a business in a foreign country - which address is reportable - the entity in US or the address for which the loan was funded?

Only loans made in the USA are reported and evaluated under CRA. It sounds like your loan was made to a US business. If you are using the criteria for geocoding based on the home office of the borrower then you would recognize the loan under CRA. If you use the location of use of proceeds criteria it looks like you would not consider the loan under CRA.

We made a loan to a foreign entity to purchase a business in the U.S. We typically geocode the address of the home office of the business entity (in this case, a foreign address). Should we not report this loan for CRA?

SECTION .42(a)(3) The loan location
SECTION __.42(a)(3) – 1: Which location should an institution record if a small business loan’s proceeds are used in a variety of locations?
A1. The institution should record the loan location by either the location of the small business borrower’s headquarters or the location where the greatest portion of the proceeds are applied, as indicated by the borrower.

However, the call report instructions say that you are to report “Commercial and industrial loans to U.S. addressees”
in domestic offices.
