We are running a television ad that references investments. I discussed this with an examiner and attended a marketing training that suggested we put the Member FDIC logo, then segregate out and put the annuity disclosure, but segregate them. In the final screen it pans to text. Does anyone have any recommendations on what the ad should state as far as the annuity. I was thinking that the following is an insurance/ annuity solicitation disclosure:


• NOT A DEPOSIT

• NOT FDIC-INSURED

• NOT INSURED BY ANY FEDERAL GOVERNMENT AGENCY

• NOT GUARANTEED BY THE BANK

• MAY GO DOWN IN VALUE


But this might be better for the ad.

(1) The insurance product or annuity is not a deposit or other obligation of, or guaranteed by, the bank or an affiliate of the bank; OR

(2) The insurance product or annuity is not insured by the Federal Deposit Insurance Corporation (FDIC) or any other agency of the United States, the bank, or (if applicable) an affiliate of the bank; and

(3) In the case of an insurance product or annuity that involves an investment risk, there is investment risk associated with the product, including the possible loss of value.
