We do not share information with non-affiliated 3rd parties. However, we do outsource some our marketing to 3rd party vendors. Would the right answer on this be the following?:

For our marketing purposes - to offer our products and services to you

Do we share: Yes
Can you limit this sharing: No

Take a look at Federal Register Vol. 74, No. 229/Tuesday, December 1, 2009 page 62944, first column, paragraphs titled (1) "For our everyday business purposes" & (2)"For our marketing purposes".

If you are sharing with service providers for your own marketing, you MAY choose to provide an opt-out. (But you may not). Therefore, I believe your disclsoure could say either:

Yes, No (we share, but you cannot opt-out because we are not offering you that ability)
or
Yes, Yes (we share, and we are giving you the right to opt-out)

We chose to go the Yes/No version..............

Our bank also shares with non-affiliated third party vendors for our own marketing. Our Marketing department thinks the new notice format will be best received by customers if we select Yes, Yes, above.

We currently put customers on our 'No Marketing Solicitations' list for this purpose (if they don't want us to market to them).

If we say Yes you may opt out of this type of sharing on our disclosure, do we need to provide an opt out option. I suspect that we would.
