Does anyone have a "standard" frivolous/irrelevant notice that they would be willing to share?

If the reason you are providing the "frivolous/irrelevant" notice is because you need more information, do you need to provide a date the consumer needs to give that info to you? If so, how long should we give them?

I don't see anything about this in the reg...I'm guessing we should limit it to some "reasonable" time frame...30 days? 15 days? 60 days?

I wouldn't provide a date. The regulation allows you to not investigate it for missing information. Keep it at that ...."We cannot investigate your claim because you did not provide the following information..." If they want to provide the info, add it to the original file with documentation of when you received it, or have them provide a new dispute notice (complete a new form if you are using one).

Giving them a "get it to us by this date" clause, ties you up with having to go back later and tie up any loose ends on the outstanding dispute. I would just send them a letter telling them that I need more info and be done with it.

I was looking for a sample notice also, does anyone have one they could send me? I guess not that difficult to come up with but I hate starting from scratch.

Thanks

I am receiving a frivolous dispute through E-OSCAR. How do I respond so E-OSCAR won't delete this account?
Thanks Dusty
