We charge a flat fee for every NSF. On a case by case basis we do not send all of the NSF checks back. (We do not advertise this process as an overdraft privilege program.) However, we ALSO charge a daily overdraft fee on top of the NSF charge. Is this a problem?

What does your Truth in Savings disclosure indicate? If the fees are in there, and they show up with the same description on the periodic statement, I think you're OK. If any of these fees are proposed, you need to give 30 days advance warning before they go into effect.
