We have a customer that had a VISA hold hit her account and make the account negative. Could we charge a fee for that before the transaction hard posts to her account? She has not opted in. Would it make a difference if she was opted in?

Unless you disclose that overdrafts can be caused by such things, I would consider it a UDAP violation.
