I've been perusing other bank's websites today and I've noticed that several still have the old dpoesit insurance notice for the TAGP. This was supposed to be changes to the new notice effective 12.31.2010 correct?

The new notice was supposed to go up by 12/31/10 (and must be replaced by the revised new notice (with the IOLTA changes) by 2/28/11.

The TAG notice was to come down by close of business on 12/31/10.

If you're on good terms with the compliance officer at the other bank, give him or her a "heads up." If not ....

Yes, and there was another recent change about IOLTA accounts now covered for the full balance. Looks like not everyone is up-to-date.

Thank you for confirming this for me.

Can I find the most recent changes (required by 2/28/11) on the FDIC's website? I was waiting to see how they were going to amend the notice with the IOLTA information but I must have missed the release somehow.

It's there, and also in BOL's "Read a Reg" or "Alphabet Soup" (both names for the same section) pages.

The FDIC's action was announced in our January 27th Compliance Briefing, and you can read the Federal Register notice HERE.

You'll find the ABC Soup copy of the FDIC's rule HERE.

Also, the FDIC updated its FAQ, which is on its site, HERE.

Do we need to send out a notice to all interest bearing account holders stating that their account is no longer fully insured? We chose to opt out of the TAGP as of 7/1/2010, do we still need to send out notices to these account holders?

If you were required to send the notice, it would have been due on 12/31/10. Fortunately, since you were not in the TAG at year end, you lucked out and don't have to send the notice. And if you still have that "Beginning July 1, 2010 [Institution Name] will no longer participate in the FDIC’s Transaction Account Guarantee Program" notice posted, get it out of your lobbies and off your website. That notice was supposed to come down at close of business on 12/31/10.
