One more thing. Can we charge say a maintenance fee and waive it if they elect e-statements?

Unless governed under State law, you can charge or not charge for whatever you choose.

At our bank, for new checking accounts, the fee is higher if a paper statement is provided. In essence, we offer a discount and in some cases waive the monthly fee if the customer registers for estatements. We have not changed anything on existing accounts opened under different parameters, but are discussing promoting estatement registration.
