Received a subpoena from NYS tax and finance today on one of our customers... #10 in the subpoena requests SARs filed!


LMAO.... they sure do try to get this information!

They should already have access to SARs as a law enforcement org.

Called FinCen once – was told we should give the information to LE in response to a subpoena. I would check with them yourself – you may be required to respond with the information if it is the LE arm of NYS Tax department (e.g., Internal Affairs, Inspector General)

It isn't law enforcement...they are auditing a former customer.

Until I get the okay from my regulator to disclose SAR information, I will not do so...and my regulator said I acted accordingly so that's that.

I called FinCEN left a message for the Office of General Counsel (or whatever it is called). Haven't heard back from them yet either...

In agreement with Big Dog..IF it is law enforcement, they should already have the SAR(s)...so they shouldn't be asking.
